My wife and I are expecting our third child any day now, so when I saw Erik Canter?s post over at Forbes.com on financial and estate planning for new parents it caught my attention. ?It is generally a good article, with solid advice. ?He suggests that new parents update their estate plans, which includes their Wills and/or their Revocable Trust documents, powers of attorney and living wills, and any beneficiary designations for retirement accounts and life insurance. ?He also suggests that parents re-evaluate life insurance coverage, review the family budget, and begin planning for college expenses. ?These are all important steps for new parents.

However, there is one critical error in Erik?s advice. ?He appears to suggest that parents should name their child (or children) as a beneficiary of life insurance and retirement benefits directly, which is almost always a terrible idea. ?This is because minors are not allowed to manage their own property, and if on the parent?s death a minor child is designated to receive insurance proceeds or retirement benefits directly, a Court will have to appoint a Guardian of the Estate to hold the property for the child until adulthood. ?

Having a Guardian of the Estate appointed requires formal legal proceedings which will produce additional legal fees (usually well in excess of the cost of planning to prevent the situation). ?Also, the time it takes to obtain an appointment of a Guardian of the Estate may cause delay in the distribution of funds which are often needed for the child?s immediate care. ?In addition, in Pennsylvania, a surviving parent may not be appointed as sole Guardian of the Estate (i.e. a co-guardian is required).

It is far more advisable to name a trust for the child as the beneficiary. ?The trust can be established in the parent?s Will, as part of a Revocable Trust, or even as a stand-alone document. ?Using a trust reduces the chance that a Guardian of the Estate will need to be appointed and allows parents to ensure a trusted adult will have control of a child?s inheritance until the child is old enough and mature enough to handle the responsibility. ?

It is very important for parents to update their estate plans when they have a child, and beneficiary designations are critical components of a comprehensive estate plan. ?That is why parents should make sure their designations name trusts for their minor children as the beneficiaries, and never as the beneficiaries directly.

Two arrested in case of kidnapped Tennessee mother, daughters

TUPELO, Miss./NASHVILLE, Tennessee (Reuters) - The wife of a man suspected of kidnapping a Tennessee mother and her three daughters has admitted she drove them to a house in Mississippi where the bodies of the mother and oldest daughter were later found, authorities said on Tuesday.

Teresa Mayes, wife of Adam Mayes, was arrested Sunday along with his mother, Mary Mayes. Both are in Hardeman County Jail in Tennessee.

Meanwhile, police in two states and the FBI continued a manhunt for Adam Mayes, 35, who is suspected of taking the two surviving daughters with him on the run.

Jo Ann Bain, 31, and her oldest daughter, Adrienne, 14, were dead, and the two younger Bain girls, Alexandria, 12, and Kyliyah, 8, were believed held by Mayes. Investigators have described him as a family friend or an uncle figure to the girls.

In an interview with Reuters, Teresa Mayes' sister Bobbi Booth said Teresa told her on Saturday that Adam Mayes had killed Jo Ann and Adrienne Bain.

Booth said she immediately contacted the Hardeman County sheriff's department. Investigators told her they knew everything and Teresa Mayes was not a suspect. Booth said she believes her sister, who is mentally challenged, is not at fault.

"My sister does not have sense enough to do what they're accusing her of," Booth said, describing Teresa as a caring woman who loves children but is "mentally slow."

Authorities believe Adam Mayes is still in north Mississippi and they are focusing their search there, said FBI spokesman Joel Siskovic. "Law enforcement agencies all believe they are alive (and) that they are with him. Our primary goal is their recovery," Siskovic said.

"That part of north Mississippi is pretty rural, it's rough terrain. There are locations back there that only people who have been there know, so we're digging through a lot of that territory, checking for signs that someone has been there."

Teresa Mayes, 31, has been charged with four counts of especially aggravated kidnapping and held on a $500,000 bond, said Hardeman County Circuit Court Clerk Linda Fulghum.

Adam Mayes' mother Mary, 65, has been charged with four counts of conspiracy to commit especially aggravated kidnapping and held on $300,000 bond, the clerk said.

The two were arrested late on Sunday in Union County, Mississippi, and transported across the state line to Hardeman County, where they were booked early on Monday, said Union County Sheriff Jimmy Edwards.

"We developed information that led us to believe that they were a part of it," he said.

An affidavit filed with the Hardeman County Court said Teresa Mayes told agents of the Tennessee Bureau of Investigation she drove the victims from Hardeman County, Tennessee, to Union County, Mississippi.

Both Teresa and Mary Mayes told investigators they saw Adam Mayes digging in the backyard in Mississippi on April 27, the day of the disappearance. Neither woman appeared to know the whereabouts of Mayes or the two Bain children, Edwards said.

Bain's husband reported the four missing from their rural Tennessee home on April 27. Mayes, who was at their home to help them move to Arizona, was quickly identified as a suspect.

Booth said that she first met the Mayes family when she and her sister were living in Florida with their parents. Adam Mayes courted her sister and the two married around 2000, Booth said.

Almost immediately Adam Mayes forbade his wife to maintain contact with her, she said. Mayes abused drugs and alcohol and kept Teresa Mayes around mainly because she cared for his ailing father.

"I seen him (Adam Mayes) in October 2001 ... and it was the same old thing, acting stupid, not wanting to take a bath, wanting to get high," said Booth. "He was abusive with my sister, but you could tell even then she was scared of him."

The first time the two sisters had spoken in more than a decade was when Teresa Mayes called Booth on Thursday. At first the conversation was casual but by Saturday Mayes told Booth that her husband had committed the murders.

Booth said Adam Mayes used to beat her sister. She said he apparently sold his motorcycle before the Bain family's disappearance and may have used the money to buy a used car and flee the area.

Teresa Mayes told Booth she thought Jo Ann Bain was having an affair with Adam Mayes.

Tennessee authorities have described Teresa Mayes as Adam Mayes' ex-wife, but Booth said she was not aware of a divorce and they were still living together.

Can 'Dark Knight Rises' Beat 'The Avengers' Debut?

The Weekly Rising investigates how the superhero box-office returns will measure up.

In the battle of the summer superhero blockbusters, journalists and box-office analysts pitched the story as "The Avengers" versus "The Dark Knight Rises." Could Marvel's crazy experiment pay off? Would it be enough to stop Batman from owning the box office once again? Most had "The Dark Knight Rises" pegged to repeat the magic that was 2008's "The Dark Knight" and the phenomenon that followed, but that was before this past weekend.

When the underdog in a war for box-office supremacy takes in $207.1 million during its opening weekend, the tide tends to shift in its favor. As soon as "The Avengers" finished its record-smashing debut, "The Dark Knight Rises" became the underdog, a shoo-in for second place.

But what happened to seemingly damn Christopher Nolan's final Batman movie to runner-up status?

The Dark Knight
When the follow-up to "Batman Begins" hit theaters in July 2008, it was a cultural event. Not only had expectations been so high for the sequel of the first great Batman movie, but the introduction of the Joker and Heath Ledger's untimely passing made the film a must-watch. Everyone was talking about it. Not only had it captured the world's headlines, but critics praised it as something more than a superhero movie. It was the perfect storm of movie buildup. Thankfully, tragedy has not struck the release of "The Dark Knight Rises," but without the headlines, it doesn't have as much momentum as its predecessor did heading into July.

"The Avengers" Is New
People have simply never seen superheroes from different films come together to fight in a single crossover movie. That's something new, and new will always sell. While that isn't to say that "The Dark Knight Rises" isn't new, it certainly doesn't mix up the superhero genre as much as "The Avengers." Comparing the two isn't even necessarily a fair fight. Marvel had the audience invest in five movies over the course of four years, eventually leading up to an ultimate sequel for each separate franchise. Two previous Nolan films exist and came out over the course of seven years. Checking out "The Avengers" simply has a higher return rate.

3-D
The surcharge for the added dimension will likely be the death knell for "The Dark Knight Rises." Each filled seat for "The Avengers" in 3-D is an automatic advantage. This seems especially significant when you learn that 3-D screenings accounted for 52 percent of the opening-weekend gross for Marvel and Disney. The added fee was also a strong factor in driving "Harry Potter and the Deathly Hallows, Part 2" to its then-record total.

Fun
Despite both being "superhero movies," "The Avengers" and "The Dark Knight Rises" are two very different films. As I discussed in last week's column, though the films feature crime fighters, they strike very different tones and attempt two very different things. "The Avengers" had crowds cheering in triumph. Its humor became an essential part of its overall entertainment value. Nolan's Batman trilogy has thus far gone for something very different. They comment on current events. There isn't always a happy ending, usually at best the glimmer of hope. "The Dark Knight Rises" may be a film people return to over a long box-office run, but "The Avengers" is the one they turn out in droves for.

Why That's OK
But here's the kicker: None of this really matters. Both films earned or will earn all our salaries just minutes after their midnight releases, and their profitability was never really in question. Christopher Nolan will work again. Joss Whedon even healed some of the "John Carter" wounds at Disney. All that matters is that we will get to see both within a few months of each other. With that in mind, how much is there really to worry about?

HTC Droid Incredible 4G LTE for Verizon hands-on at CTIA 2012 (update: video)

This handset didn't surprise anyone when it was officially announced at CTIA Wireless 2012, but we're still happy to spend time with the HTC Droid Incredible 4G LTE for Verizon Wireless regardless. After catching enough glimpses of the smartphone over the past few months, we already had a good idea of what to expect: Big Red's latest LTE device will have Ice Cream Sandwich dressed in Sense 4, a 4-inch Super LCD qHD panel, a 1.2GHz dual-core Snapdragon S4 (Krait), 1,700mAh user-removable battery, microSD support and an 8MP BSI f/2.2 camera with a 28mm lens.

If you're familiar with either the OG HTC Droid Incredible or its sequel, you'll instantly recognize the trusty hump on the back of the third iteration -- Verizon and HTC haven't strayed too far from the design formula here. Aside from the Sense 4 firmware hiding inside the phone, the Incredible 4G LTE has little in common with its cousins, the One X and One S. Frankly, we're still left pondering if the carrier will come out with a version of its own, since we've seen the other three national powers get a high-profile device from the Taiwanese manufacturer.

We had a very similar feeling when holding the new Incredible, one easily related to how we felt with its predecessors. It's quite light, and it actually feels thinner than it really is. All in all, the phone is very comfortable to hold, and from our few minutes of using it, it seemed to be rather smooth. Naturally, as we expected, Verizon reps warned us that it's running on preliminary firmware at the moment, so we don't take a lot of stock in its performance, good or bad. All in all, it's exactly how we thought it would be -- a refreshed version of the Incredible 2, with a much better processor and a few other notable bumps in specs. 'The Avengers': Five Visual-Effects Secrets Revealed

At the end of the day, "Marvel's The Avengers" is all about character. If the viewer doesn't feel invested in the conflict between Tony Stark and Steve Rogers, the inner-turmoil Bruce Banner feels as he keeps "the other guy" at bay or any other number of relationships, then the movie as a whole simply does not work.

Thankfully, all those things work with flying colors due to the winning combination of Joss Whedon's direction and script and the performances from Earth's mightiest actors themselves. But while story is a crucial component to the success of "The Avengers," spectacle cannot be downplayed as another essential ingredient. The film's visual-effects supervisor Jeff White and his team had their work more than cut out for them when approaching "The Avengers," a movie filled with no fewer than six superheroes, one particularly nasty supervillain and an entire alien armada to fight for his cause.

MTV News spoke with White about his work on the film, what he viewed as the greatest visual-effects challenges, why the Hulk was key to the movie's success and what it was like working with Whedon.

The Biggest Challenge
In short? Everything. "At the end of the day, with 'Avengers,' there were so many things to get right," White told MTV News about the biggest difficulties facing his team. "We created a lot of New York City for the film and needed to build flying shots of Iron Man all from photography. We had to build a new Iron Man suit — the Mark VII — and Stark Tower. We had to build the alien race. When you add all of those things up, there are quite a few challenges there."

That's not even mentioning the S.H.I.E.L.D. Helicarrier, the floating base of operations for Earth's mightiest heroes. "That was a massive undertaking," White said. "The challenge was not only building the Helicarrier, but then having to build the atrium underneath that you fly into. Then we had to build all of the set dressing to make it feel like it was a populated vehicle: the flight crew, digital doubles, the vehicles pulling objects around, planes on the deck ... all of that stuff, if it's not there, makes everything feel very CG, because it'd be so empty."

We Have a Hulk ...
Still, if there was one particular ingredient White had to get right, the answer is easy: the Hulk. Already a big fan of Bruce Banner's monstrous alter-ego going into the project, White said so much of "Avengers" leans on the existence of a compelling Jade Giant.

"It was important to deliver on the performance that Joss was looking for. He knew exactly the Hulk he wanted to bring to the big screen. All of the great moments Hulk has in the film was Joss really guiding us there," White said of creating the latest take on Hulk. "We wanted this guy to be as photo-real as we could make him. He's not in a solo film; he's part of an ensemble team. We wanted it to feel very natural when he's sitting in that circle of Avengers. We didn't want him to pop off or seem separate from the rest of them. So in that vein, we spent a lot of time working on his skin and his hair and his teeth, just to make sure that all of that was believable."

... But They Have an Army
Just as important are the enemies Hulk goes up against — namely the Chitauri, the alien warriors Loki recruits to help him take over Earth. As they're not the most iconic creatures in Marvel Comics lore, the "Avengers" design team had some freedom in bringing the heroes' enemies to the big screen.

"They'd done some initial designs at Marvel, as far as getting their overall forms in place. They came up with this idea of a mixture of metals and leather and skin, and then we ran with that as far as what the textural details were, making sure that the chariots had enough variety in them, making sure that when we initially started, we wouldn't see the aliens with their helmets off — and then through the course of production, we do see them that way," White said. "That was a whole round of design processes: What do they look like? What do their heads look like under that armor? I think one of the great parts of them is they're wearing all of that armor — it's worn, they've clearly been through several battles — but you can still see their eyes in there. That's an important part of connecting them as a threat to the Avengers."

Release the Leviathan
The Chitauri foot soldiers aren't the only threats the Avengers have to worry about in the film. There are also the massive Leviathans, giant sky serpents hell-bent on destroying Manhattan. "That's all about scale," White said of those creatures. "It was such a great opportunity to have these massive creatures ambling around New York. Part of their design was to put these wings on them, which made them too wide to fit down a New York street, which in turn led us to have them tearing through buildings and causing mayhem everywhere they go."

Some fans have likened the Leviathans to something out of a Michael Bay "Transformers" movie — an observation that's all the more interesting when considering White's previous visual-effects work on those very same films.

"You can see where the 'Transformers' comparisons come from as far as the trailers go. But when you see how the Leviathans operate in the film, and the role they fill and what drives them forward, there's a pretty big difference," White said. "Driller from 'Transformers' was all metal and all machine, digging through the ground to take down a building. These guys are actually organic beneath all of that armor. They have these worn gold plates and energy signatures that ripple down the side. We really tried to make sure that they felt unique. But I agree, when the first trailer came out, that ['Transformers' similarity] was a component of it, but when you see them in the entire film, they really serve a very different purpose."

The Geek God's Influence
Creating aerial bases, giant green rage-monsters, chariot-riding aliens and massive flying serpents is all well and good, but for White, the real thrill of working on "Avengers" was collaborating with Whedon, a storyteller who White was already very fond of going into the project.

"It was fantastic," White said of working with Whedon. "He's involved in the [visual-effects] process every step of the way. Joss is so good at working with actors, and that extended right through working with animation and trying to get that same performance, really coaching us along. 'Here's what we want to see, here's where you really want that look to get the emotion across his face.' Everything he does so well with writing and actors really translated into his direction for working with the Hulk. He was involved in the entire effects process and every review. It was great working with him."

New metal mix could lead to cheap, plentiful sodium-ion batteries in gadgets

Lithium batteries very frequently power our gadgets, but the material itself isn't common and, by extension, isn't cheap. Researchers at the Tokyo University of Science aim to solve that through sodium-ion batteries using a new electrode material. By mixing together oxides of iron, manganese and sodium, Shinichi Komaba and team have managed to get a sodium battery's electrode holding a charge closer to that of a lithium-ion battery while using a much more abundant material. Having just 30 total charges means this simplest form of sodium-ion battery technology could be years away from finding a home in your next smartphone or EV, although it's not the only option. Argonne National Laboratory's Chris Johnson has co-developed a more exotic vanadium pentoxide electrode that could produce 200 charges while keeping the battery itself made out of an ingredient you more often find in your table salt than your mobile gear.

After a long bout with cancer, the Beastie Boys' Adam Yauch died on Friday (May 4). The rapper's death comes as a huge blow to fans of his work with the iconic trio, but he'll also be remembered for the imprint he left on the film world.

While he's widely known as a co-founder of the Brooklyn hip-hop group, MCA was an accomplished director and producer, and his music is featured on an array of popular music soundtracks. The Hollywood community took to Twitter this afternoon to share their thoughts, with Ben Stiller tweeting, "So sad that Adam Yauch is gone. A truly great musician & filmmaker. He stood for integrity as an artist. What a loss. He was a very good man." While Jonah Hill followed up with a heartfelt tweet: "I'm filled with so much sorrow to hear about the world losing Adam Yauch. He was such a beautiful person and artist. My heart is broken."

As fans mourn the loss, MTV News honors his career and achievements on the big screen.

"Fight for Your Right Revisited"
The comedic short was Yauch's most recent writing and direction project and it debuted at the 2011 Sundance Film Festival. With as ensemble cast that includes Elijah Wood, Danny McBride, Seth Rogen, Susan Sarandon, Will Arnett and Stanley Tucci, the story picks up from the raging party at the close of the trio's 1987 "(You Gotta) Fight for Your Right (To Party)" music video. The sequel follows the Beastie Boys and their delinquent antics as they break into a bodega to steal beer and try to out-breakdance their future selves.

"Awesome: I F---in' Shot That!"
Yauch produced and directed this memorable Beasties documentary, using footage shot by 50 fans at their 2004 Madison Square Garden concert. Audience members were given video cameras and asked to shoot the whole show. The project was meant to re-create for viewers at the home the exhilarating fan-experience of attending a sold-out show. Interestingly enough, MCA's producer credit for the project is under the name of Nathaniel Hornblower, Yauch's "Swiss uncle" and alter ego.

Oscilloscope
In 2008, Yauch made his directorial debut with "Gunnin' for That #1 Spot," a doc about street basketball. The film follows eight of 24 high-school basketball players competing in the Boost Mobile Elite 24 Hoops Classic at Harlem, New York's famed Rucker Park. Of the eight players Yauch chose, six now have careers in the NBA, proving his eye for talent.

"Gunnin' " also marked one of his production company's first efforts. Oscilloscope Laboratories has gone on to distribute a number of well-known works, including "Howl," the Allen Ginsberg biopic starring James Franco, and the Oscar-nominated thriller "We Need to Talk About Kevin," starring Tilda Swinton. The company recently announced that they had acquired the rights to the documentary "The Apple Pushers," which tells the stories of immigrant street vendors who sell fruits and vegetables in poor New York City neighborhoods. The film is narrated by Edward Norton.

Soundtracks
MCA's music with the Beastie Boys has been featured on countless movie soundtracks, including "Baby Mama," "17 Again," J.J. Abrams' "Star Trek," "Shrek Forever After," "Iron Man 2," "Horrible Bosses" and the Hugh Jackman robotic-action flick "Real Steel." They also had hit songs featured in the video games "Guitar Hero III: Legends of Rock" ("Sabotage") and "Tony Hawk's Proving Ground" ("Electric Worm").
